Digital Folio® Privacy Policy

Digital Folio ("Digital Folio," "we," or "our") is committed to protecting the privacy of every user of the Digital Folio software, tools, website, and services ("Services"). Our privacy policy covers any information a user provides, including but not limited to personal information entered during registration on our Services and information or key words entered during an on-line search using our Services.

Our privacy policy ensures that:

  • Each user's privacy remains under his/her control
  • Personal information provided by a user is only used by us according to the terms of this Privacy Policy
  • We never disclose a user's personal information to any third party without the user's consent, unless required to do so by law
  • A user can cancel his/her Digital Folio account at any time

Personal and Non-Personal Information

We routinely collect data such as users' demographic, preference, and other personal information as well as other statistics from our Services including usage data related to retail product, retail product-related content, Digital Folio tools, and promotion response. When a user registers for our Services or uses certain features of our Services, we may collect his/her personal information such as username/email address and password. Each user is required to provide such personal information upon Digital Folio Services registration in exchange for standard use of available Digital Folio Services

Currently unforeseen developments may require us to request additional personal information from users in the future. While the input of such additional personal information will be optional, some future Digital Folio Services may not function correctly without such input.

All personal information is collected and analyzed so we may provide all our users with optimal service. Such information is used not only to track and provide analytics, but to expedite service inquiries. Future Digital Folio newsletters or other marketing or promotional materials also may be distributed via user-provided personal information. An opt-out option for all such communications from us will always be offered.

Non-personal information also may be collected and provided to third parties for their general information regarding typical use of our Services. Such non-personal information ordinarily includes non-identifiable aggregate, summary, usage data, and other behavioral data such as statistics regarding total users, information regarding types of Internet browsers used by users, and behavioral usage patterns. We also collect non-personal information about each user's IP address to help diagnose server problems and to administer our Services.

Log Data

Log Data includes information sent by a user's browser such as the user's computer's IP address, referring HTTP address, current HTTP address, time of access, and other statistics. Each time a user visits our web sites or uses our Services, our servers record and collect Log Data sent by his/her browser. We use Log Data to monitor and analyze the use of our Services, for technical administration, to increase our Services and Tool's functionality, and to better tailor our Services to user needs.

In the future Log Data also may be collected each time a user visits third-party websites serving content that uses our Services. Log Data from such websites may be collected and combined with other non-personal information in the creation of reports and data we and third-party sites may use to create or enhance specific products, services, or advertising.

Digital Folio does not link Log Data to any personal information or use Log Data in an attempt to determine a user's identity.


Any user who registers for Digital Folio Services by providing personal information certifies that he/she is over the age of 13. We do not collect or maintain personal information from individuals we know are under 13 years of age; no part of our Services is designed to attract people under age 13. If we obtain knowledge that a user of our Services is under age 13, we will remove that user's personal information from our databases and prevent the user from signing onto our Services in the future.


In order to save a user's registration information for future logins, Digital Folio uses browser cookies on our Services. We also use browser cookies to allow us to better understand how users interact with our Services and to monitor traffic routing that involves our Services. We also use browser cookies to collect Log Data as described in the Log Data section above. Any computer user can instruct his/her browser to stop accepting browser cookies or to post a prompt before accepting a cookie from any website.

A Digital Folio user whose computer is set up to not accept browser cookies may not be able to access all portions of our Services or all functionality of our Services.

Use and Disclosure of Collected Information

We do not share personal information collected via our Services, including email addresses, with third parties for their direct marketing or solicitation.

We may use a user's personal information to:

  • deliver desired services and features (including any requested customization features)
  • improve our services to a particular user
  • personalize content and offers that may be of interest to a user
  • respond to a user's inquiries
  • fulfill a user's request for products or services

We may use non-personal information such as an IP address to analyze statistical Services usage and customize our Services' content, layout, and offerings. We may share the following information with third parties that include, but are not limited to, vendors that support the operation of our Services and entities involved in the delivery of advertisements:

  • Log Data collected regarding our Services
  • Aggregated anonymous information resulting from Log Data analysis

Such Log Data analysis may be conducted in the study of items such as usage patterns, behavioral patterns, or traffic and demographic analysis, or to enable advertisers to target appropriate audience segments.

In addition to a user's username, any user comments or submissions ("Unsolicited Information") posted via our Services may be made publicly available. All such Unsolicited Information will be deemed non-confidential; Digital Folio will be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution. Any such Unsolicited Information can be collected and used by others. A user, for example, who posts his/her email address in a comments section or online forum may receive unsolicited email messages. Digital Folio has no control over the use of any such personal information voluntarily posted or otherwise disclosed via our Services. We suggest Digital Folio users not disclose personal information via user comments or submissions.

Third-Party Providers

In the future, we may employ third-party companies or individuals to facilitate our Services, provide our Services on our behalf, or perform services related to the administration of our Services (including, without limitation: maintenance, hosting and database management services, and administration). In such a case, such third parties may be given access to users' personal information and Log Data as needed to perform these tasks on our behalf. They will be obligated not to disclose or use such information for any other purpose.

Compliance with Law

Digital Folio cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We disclose users' personal information and Log Data to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to:

  • respond to claims and legal process (including but not limited to subpoenas)
  • protect the property and rights of Digital Folio or a third party
  • protect the safety of the public or any person
  • prevent or stop any activity we may consider potentially illegal or legally actionable

Business Transfers

Digital Folio may sell, transfer, or otherwise share some or all of its assets, including users' personal information and Log Data, in connection with a merger, acquisition, reorganization, or sale of assets or in the event of bankruptcy. Each user will be given the opportunity to opt out of any such transfer if the new entity's planned processing of such information differs materially from that set forth in this Privacy Policy.

International Transfers

Digital Folio user information may be transferred to, and maintained on, computers located outside a user's state, province, country, or other governmental jurisdiction where privacy laws may not be as protective as those in the user's jurisdiction. If a user located outside the United States chooses to provide personal information to Digital Folio, that user must be aware that we transfer such personal information to the United States and process it there. A user's consent to this Privacy Policy followed by submission of such information represents that user's agreement to that transfer.


In the future our Services may contain links to other third-party websites and services. If a user chooses to click on a third-party link, he/she will be directed to that third party's website or service. The fact that we link to a website or service is not an endorsement, authorization, or representation that we are affiliated with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third-party websites or services. Third-party websites may place cookies or other files on a user's computer, collect data, or solicit personal information. They also may follow different rules regarding the use or disclosure of personal information submitted to them. We encourage all users to read the privacy policies or statements of all websites they visit.

Data Security

While Digital Folio endeavors to provide reasonable security for information in our possession and control, no security system can prevent all potential security breaches. For this reason, we bear no liability for uses or disclosures of personal or non-personal information arising in connection with the theft thereof. Each user is responsible for safeguarding the confidentiality of his/her password to our Services. For this reason, we also bear no liability for access to or use or disclosure of personal information if such access, use, or disclosure arises in connection with the theft or disclosure (whether intentional or negligent) of a user's password.

Privacy Policy Changes

Any changes to our Privacy Policy will be posted on our Services. Users will always have access to details regarding information we collect; how such information is used by us; and under what circumstances, if any, such information may be disclosed by us. Any posted Privacy Policy change will be effective upon the date of its posting. A user's continued access to and/or use of our Services constitutes assent to and acceptance of this Privacy Policy, including all posted changes for which we have provided notice.
